White Collar, Investigations & Government Controversies

  •

Government enforcement cases and investigations can lead to severe legal and financial consequences – both in cases where there are allegations of criminal conduct and in those where there are not.

Overview

Anchored by Experience

Anchored by former federal prosecutors and enforcement attorneys, our lawyers have decades of experience handling virtually every type of government controversy and investigation, including antibribery (FCPA), accounting and securities fraud, healthcare fraud, government procurement fraud, tax fraud, spoofing and other market manipulation, and sanctions/AML/BSA, and antitrust.

Leveraging our in-depth experience in private practice and at agencies, including the Department of Justice, United States Attorneys' Offices, Securities and Exchange Commission, and Commodity Futures Trading Commission, and the Federal Trade Commission, we know how government investigations are conducted, which helps us develop sophisticated defense strategies and allows us to respond promptly and efficiently.

Experienced in both civil and criminal proceedings, we represent individuals, financial institutions, and companies in domestic, international, and cross-border matters. We also frequently represent clients in concurrent criminal, civil, and administrative "parallel proceedings," and have negotiated "global" dispositions of serious matters involving multiple government agencies and multiple civil and criminal enforcement proceedings. Our experience spans a wide range of industries, including financial services, energy, logistics, infrastructure, and many others.

Full Range of Representation

Whatever the forum, matter of law, or industry, handling government litigation and investigations almost always involves high stakes. We have the credentials, bench strength, and track record to serve both as trusted advisors in complex investigations and controversies, as well as potent advocates if cases cannot be resolved through negotiation. We also routinely conduct internal investigations for private and public entities in matters involving the workings of government and in matters that could potentially ripen into government investigation or litigation. Further, we have worked with a wide range of industries, and this real-world business perspective informs our arguments and strategies.

Practical Solutions

Our team works closely with in-house counsel, senior management, boards of directors, audit committees, and special committees to ensure clients respond to government investigations properly while doing everything possible to minimize disruption to ordinary business activities. While we advocate zealously for our clients, we do so in a manner that preserves relationships with government officials to help facilitate satisfactory resolutions of client matters. Whenever feasible, we seek to assist our clients in proactively avoiding government investigations or formal disputes before they begin, and, when adversarial proceedings become necessary, to position them for the best possible outcome.
